The current economic crisis and its causes challenge all organizations involved in the area and individual citizens.
So not only for its possible effects on social cohesion of the country but also the risk of creating or reinforcing the already widespread feeling of helplessness and lack of interest in the collective destiny of the country.
In this context there is a strong concern about the problems and the growth of southern Italy on which the Churches of the South have found it necessary to question (Conference in Naples on February 12 and 13) at 20 years by the Italian Bishops' Conference document on " Church and Italian Mezzogiorno " significantly when it was launched a strong challenge: "The country will not grow if not together."
And in this sense an important contribution to reflection and commitment is the recent publication of Puglia economist Prof. Gianfranco Viesti on "treason to the South. The North, South and the policy that does not exist "(Editori Laterza).
E 'is quite evident as policy, now more than ever, is urged in its task of reading the social and economic phenomena to discover the function of "government" that can never be identified in a straightforward representation and management of the amount of interest details. The coalition
I support the candidate for Mayor (Democrats for the Constitution, PRC, PDCI, Democratic Left and Italy of Values), by virtue of a shared determination to build a new center, aims to promote an open debate, and then comparing rich and productive for the future of the city.
The challenge is huge. But we can not allow that in the face of the serious and dramatic problems that have embarrassed reiterate old logic of human skills and financial resources plundered with devastating results for the area.

WHEREAS
-these days they are aware of a tender care from the company Francavilla Environment Consortium Limited (based in Capurso - BA Provincial Road Trigg Carbonara - 0.600 km - REA No. 439702) as first-class operator of the landfill located in Francavilla Fontana. Once that contract award the work to implement a system of selection and biostabilisation;
-time occurs during the management of the Municipality of Francavilla Commissarial F.na;
-Francavilla F.na City Council, before the winding-up provisions for the resignation of Dr. Mayor. Joseph Marinotti, at its meeting on 14.03.2008 had approved unanimously on an agenda with which he urged the calling of a conference dei servizi con l’intervento delle Autorità competenti (ATO BR/1, ATO BR/2, Provincia di Brindisi e Regione Puglia) al fine di predisporre ogni opportuno iter volto alla esclusione del territorio di Francavilla Fontana da ulteriori insediamenti di discariche o impianti per il trattamento di R.S.U. impegnando nel contempo gli Organi competenti ad individuare,quale sede dell’impianto di selezione e di biostabilizzazione, quella in adiacenza o prossimità di discarica di servizio/soccorso da avviare ex novo in territorio esterno al Comune di Francavilla;
-tale decisione veniva adottata a seguito della mozione presentata dal sottoscritto Avv. Mario Filomeno in data 28.09.2007, discussa nelle sedute consiliari del 15.10.2007 e 12.11.2007 and rejected by the majority, and as a result of successive calls came from a committee of citizens;

was also resolved that the assumption on the basis of statements by the President of the ATO BR / 2 dr. -to this point remain intact, and then abbisognevoli strict, be postponed and urgent investigations (these days seems to be in the process of defining the invitation to tender for the work to implement dell’impianto di biostabilizzazione),sia in sede amministrativa sia in sede giudiziaria, tutti i rilievi e le censure mosse in ordine all’iter promosso e perfezionato a suo tempo dalla Regione Puglia e definitosi con l’aggiudicazione in favore della Francavilla Ambiente della realizzazione dell’impianto di selezione e biostabilizzazione.
Il tutto,parrebbe, sul presupposto della gestione in atto,sempre nel territorio di Francavilla, di una discarica di servizio/soccorso mentre trattasi di discarica di rifiuti “tal quali”.
All’uopo si richiama il contenuto integrale della menzionata mozione che si allega al presente esposto e comunque già trasmesso nel settembre/ottobre 2007 alle Administrative and political authorities in address;

-inoltre il legale rappresentante della Francavilla Ambiente,unitamente al legale rappresentante della ditta MONTECO s.r.l. che gestisce nel Comune di Francavilla l’appalto per la raccolta dei rifiuti solidi urbani, risulta sottoposto a procedimento penale c/o il Tribunale di Brindisi (Proc. TUTTO CIO’ PREMESSO E CONSIDERATO
risultati vani tutti i tentativi posti in essere sia sul piano politico sia sul piano amministrativo (raccolta di firme, mozione, Ordini del giorno) e trattandosi non di mere dispute politico-amministrative, si chiede che le Autorità in indirizzo,ciascuno per quanto di competenza e previa acquisizione di ogni opportuna informativa e documentazione di cui alla mozione ed ai fatti innanzi esposti, procedano nei rigorosi accertamenti invocati al fine di assicurare il controllo di legittimità e di legalità sia dell’iter procedurale che ha determinato l’affidamento a suo tempo della realizzazione e gestione dell’impianto “complesso” sia la gestione della discarica di rifiuti “tal quali” con ogni conseguente ed opportuno provvedimento.
Tanto a tutela e garanzia della sicurezza e dei diritti costituzionalmente riconosciuti in favore dei singoli cittadini e all’intera local community.

Su tale scorta il Giudice,in data 27.10.08, ha emesso un provvedimento cautelare a tutela delle ragioni fatte valere ordinando alla Francavilla Ambiente a porre in essere con “immediatezza” una serie di interventi organizzativi volti a contrastare fenomeni di immissioni diffuse e fughe di gas (copertura giornaliera sistematica dei rifiuti, esauriente ed approfondita “analisi di valutazione dei rischi” onde predisporre interventi correttivi..).
TUTTO CIO’ PREMESSO E CONSIDERATO
risultati vani tutti i tentativi posti in essere sia sul piano politico sia sul piano amministrativo (raccolta di firme, mozione, Ordini del giorno) e trattandosi non di mere dispute politico-amministrative, si chiede che le Autorità in indirizzo,ciascuno per quanto di competenza e previa acquisizione di ogni opportuna informativa e documentazione di cui alla mozione ed ai fatti innanzi esposti, procedano nei rigorosi accertamenti invocati al fine di assicurare il controllo di legittimità e di legalità sia dell’iter procedurale che ha determinato l’affidamento a suo tempo della realizzazione e gestione dell’impianto “complesso” sia la gestione della discarica di rifiuti “tal quali” con ogni conseguente ed opportuno provvedimento.
Tanto a tutela e garanzia della sicurezza e dei diritti costituzionalmente riconosciuti in favore dei singoli cittadini e all’intera local community.
